Is Polymarket Legal? What the Rules Say in the US and Beyond

By WhaleSays Editorial · Sources checked · 10 min read

It depends on where you live and which Polymarket you mean. polymarket.com is closed to new US and UK trades. US residents can use Polymarket US, a separate CFTC-regulated app whose sports contracts several states are contesting in court. France, Germany and Australia treat Polymarket as illegal gambling, and the UK regulator says products like it would need a gambling licence.

polymarket.com vs Polymarket US: two different products

Most confusion about legality comes from treating “Polymarket” as one product. There are two, and they sit under different rules.

Who can tradePeople outside the restricted list. Its geoblock list shows the US as close-only: you can close existing positions but not open new ones. The terms of use bar residents of listed places, including the US (terms, effective August 11, 2026).US residents. RegulationIn 2022 the CFTC settled charges against Polymarket’s then operator, Blockratize, Inc., for running an unregistered facility for event-based binary options: a $1.4 million penalty and an order to wind down non-compliant markets (CFTC, January 3, 2022).Described in its docs as a CFTC-regulated exchange that is both a designated contract market and a derivatives clearing organization (Polymarket US docs). A CFTC staff letter of December 11, 2025 also refers to Polymarket US as a designated contract market and to its clearing arm as a derivatives clearing organization (CFTC letter 25-48).

United States: federal and state rules

In the US, two layers of law meet. Federally, the CFTC regulates derivatives, and it has treated event-based contracts as swaps (see the 2022 order above). States regulate gambling, and sports wagering in particular. Polymarket US operates under a CFTC designation and argues that this decides the question. Several states say their gambling laws still apply to sports contracts.

State action reported so far

These are reports, with the date each source was published. We have not read the court filings.

  • Tennessee: the Sports Wagering Council wrote to Polymarket, Kalshi and Crypto.com in January 2026 ordering them to stop offering sports event contracts to Tennessee customers (The Block, January 10, 2026).
  • Ohio: state officials sent cease-and-desist letters to prediction-market operators in October 2026, and Polymarket US sued Ohio officials in federal court (Crypto Briefing, October 21, 2026).
  • Michigan: under a stipulation approved by a federal court, Polymarket US agreed to stop offering new sports contracts to Michigan customers and to close remaining positions by November 25, 2026. The state agreed not to take enforcement action while Polymarket complies (Michigan Gaming Control Board, October 28, 2026; also G3 Newswire).
  • Other states: Fox Sports’ state-by-state guide, published October 5, 2026, marks Massachusetts, Michigan, Nevada and Washington as restricted, describes Rhode Island and New Mexico as contested in court, and says Connecticut sent cease-and-desist letters (Fox Sports). Its state table covers Kalshi and Polymarket together, and its notes for Massachusetts and Michigan describe court orders against Kalshi, so it is not a Polymarket-only list.

What the federal courts have said

The big question is whether sports event contracts on a CFTC-registered exchange are “swaps” that federal law reserves to the CFTC. The appeals-court cases we found involve Kalshi, not Polymarket, but they decide the same question and the courts disagree:

  • The Third Circuit, in April 2026, held 2–1 that such contracts are swaps and that New Jersey’s gambling laws are preempted, in a ruling on a preliminary injunction (Skadden).
  • The Ninth Circuit, on August 28, 2026, held that Kalshi was unlikely to show its sports contracts are swaps that state law cannot reach, which let Nevada apply its gaming laws (Proskauer).
  • The Sixth Circuit, on September 25, 2026, ruled that sports event contracts are not swaps and that federal law does not preempt Ohio’s sports gaming laws (Crypto Briefing).

So there is no single answer for the US yet. If you live in the US, use Polymarket US and read what the app offers in your state. Do not try to use polymarket.com: its terms bar US residents.

Other countries: Polymarket’s list and national regulators

Polymarket’s own list

Polymarket publishes where it blocks new trading. Its help center says 40 countries are fully blocked (its table lists 41), plus four Canadian provinces and three regions of Ukraine, and notes the list rests on sanctions and on “additional regulatory restrictions” (help center, updated October 29, 2026). Its developer docs sort the same places into a short fully-blocked group (Iran, Syria, Cuba, North Korea and the Ukrainian regions of Crimea, Donetsk and Luhansk) and a long close-only group, which includes the US, the UK, France, Germany, Italy, Poland, Australia, Brazil and Singapore (geoblock docs). The two pages differ on a few countries, so we follow the docs for categories.

“Close-only” means you can close positions you already hold but cannot open new ones. Germany is a special case in the help center: trading is prohibited and positions must be held to resolution before the proceeds can be withdrawn. Our availability page keeps the full country-by-country list (last checked October 25, 2026), so we do not repeat it here.

What national regulators have said

What regulators in five places have said about Polymarket
TopicPolymarket’s own listWhat the regulator said
United KingdomClose-only: new trades blocked. The Gambling Commission said on February 4, 2026 that current prediction-market products would appear to be “betting intermediary” activity under UK law, that it does not believe an operator could classify them as non-gambling, and that operating without a licence carries criminal offences (Gambling Commission blog).
FranceClose-only: new trades blocked. The ANJ ordered internet providers to block Polymarket on July 16, 2026, saying it promotes an illegal gambling offer (ANJ, July 17, 2026). In February it called prediction-market sites unauthorised and illegal gambling services (ANJ, February 25, 2026).
GermanyTrading prohibited per the help center; close-only in the docs. The GGL warned on September 5, 2025 that paid “social bets”, naming Polymarket, are not licensable under German law and so are illegal, and that organising or taking part can be punishable (GGL, in German). On June 19, 2026 it joined eight other European regulators in a statement on prediction markets (GGL).
AustraliaClose-only: new trades blocked. The ACMA asked internet providers to block Polymarket in August 2025 after finding it breached the Interactive Gambling Act 2001, after a formal warning dated July 2, 2025, as the ACMA reported it (ACMA, August 2025 and case page).
CanadaClose-only in Ontario, British Columbia, Alberta and Quebec; open elsewhere. The Capital Markets Tribunal approved an Ontario Securities Commission settlement with Polymarket’s operators on April 17, 2025, over offering binary options in Ontario. They agreed to keep Ontario residents out (Tribunal decision). We found no comparable statement from other provinces.

Where Polymarket is open

Polymarket’s list leaves most of the world open, including Mexico, Colombia, Chile, Peru, Nigeria, Kenya, South Africa, Philippines and Canada outside the four provinces above. Open means Polymarket accepts you. It is not an approval from your government. The GGL’s summary of the June 2026 European statement says many countries regulate prediction markets unclearly or not at all, so the law in your country may simply not have caught up. If your country has a gambling or financial regulator, read what it says before you sign up.

Is Polymarket gambling?

There is no single answer, because the label depends on who applies it. Here is how each side describes it, from their own words:

  • Polymarket: a market where, “instead of betting against a house, you trade shares with other users” (Polymarket 101). Polymarket US calls itself a CFTC-regulated exchange for event contracts (docs).
  • The CFTC: treated Polymarket’s event-based binary options as swaps that had to be offered on a registered exchange (2022 order).
  • Gambling regulators: France and Germany call it illegal gambling, Australia found a breach of its gambling law, and the UK Gambling Commission says such products would need a gambling licence (table above).
  • US states and courts: Tennessee, Michigan and Ohio treat sports contracts as sports wagering. The Ninth and Sixth Circuits let state gaming laws apply in the cases before them, while the Third Circuit held that federal law preempts New Jersey’s.

One real difference from a sportsbook is that Polymarket does not take the other side of your trade: you trade with other users. We compare the two in Polymarket vs sportsbooks. The risk is the same, though. Prices move, you can lose the whole amount you trade, and our responsible trading page explains how to set limits.

Taxes

Tax treatment depends on your country and on how its tax authority classifies prediction-market gains and losses. We do not cover it and cannot advise on it. Polymarket’s terms of use say it is your sole responsibility to determine the tax consequences of your transactions (terms, effective August 11, 2026). Keep records of your trades and ask a tax adviser in your country.

What we do not know

  • Whether Polymarket US is open to you right now. It depends on your state and on court cases that are still moving.
  • How the Supreme Court or other appeals courts will rule on sports event contracts.
  • Whether regulators in countries marked open will act. We found regulator statements for the places in the table above, not for every country.
  • How any regulator treats individual traders as opposed to the platform. The GGL says taking part can be punishable. We have not tracked enforcement against users.
  • The exact current country list. Polymarket’s help center and developer docs disagree on a few countries.

Frequently asked questions

Is Polymarket legal in the United States?
It depends which Polymarket. polymarket.com does not accept new trades from US residents: its country list shows the US as close-only. Polymarket US is a separate app operated on an exchange designated by the CFTC, the federal derivatives regulator. Several states dispute whether sports contracts on such exchanges can be offered to their residents, and US appeals courts have disagreed, so the answer can differ by state and by contract. This is information, not legal advice.
Is Polymarket US available in every state?
No. Michigan’s gaming regulator, for example, announced on October 28, 2026 that Polymarket US agreed to stop offering new sports contracts to Michigan customers and to close open positions by November 25, 2026. Other states have sent cease-and-desist letters or gone to court. The app and its terms show what is open to you, and the situation changes quickly.
Is Polymarket legal in the UK?
polymarket.com does not accept new trades from the UK. In a February 2026 blog post the UK Gambling Commission said current prediction-market products would appear to fall under the legal definition of a betting intermediary, which needs a Gambling Commission licence, and that unlicensed operators should not target or transact with consumers in Great Britain. The post does not name Polymarket. It compares prediction markets to betting exchanges, which the Commission already licenses.
Is Polymarket legal in Canada?
Polymarket’s own list blocks new trades from Ontario, British Columbia, Alberta and Quebec. A settlement approved by Ontario’s Capital Markets Tribunal on April 17, 2025 resolved claims by the Ontario Securities Commission that Polymarket’s operators offered binary options in Ontario in breach of securities law, and they agreed to keep Ontario residents out. For the other provinces Polymarket says it is open, but that is Polymarket’s own rule, not approval by a Canadian regulator, so check your province’s rules.
Is Polymarket legal in France or Germany?
Both regulators have said no. France’s gambling authority, the ANJ, ordered internet providers to block Polymarket on July 16, 2026 and calls prediction-market sites illegal gambling services. Germany’s gambling authority, the GGL, warned on September 5, 2025 that bets like those on Polymarket cannot be licensed under German law and are therefore illegal. Polymarket’s own list also closes both countries to new trades.
Is Polymarket gambling?
It depends who you ask. Polymarket describes itself as a market where you trade shares with other users instead of betting against a house. The CFTC has treated event contracts as swaps, a type of derivative. Gambling regulators in France, Germany and Australia have treated Polymarket as gambling, the UK regulator says prediction-market products like it would need a gambling licence, and some US states treat sports contracts as sports wagering. Whatever the label, you can lose everything you stake.
Can I use a VPN to get around a block?
No. Polymarket’s help center says it strictly prohibits using a VPN or similar tools to bypass geographic restrictions, and that users must follow the rules to avoid penalties. Its terms of use prohibit it too. WhaleSays does not recommend it. If Polymarket is not available where you live, do not try to trade.
Do I pay tax on Polymarket winnings?
That depends on your country and on how its tax authority classifies the gains, which this page cannot decide. Polymarket’s terms of use say it is your sole responsibility to work out the tax consequences of your transactions. A tax adviser in your country can tell you how gains and losses are treated.
